Do small companies get penalized in anyway for laying off people? I was clearly laid off because the company was struggling financially and couldn’t afford to keep me on. But now my ex-boss is claiming I was “fired”. I am trying to figure out why she is changing her tune.

It should not matter if you are trying to claim unemployment (assuming a w-2 employee).
Otherwise, no penalties for laying off. However, hiring might get more difficult.

Yes small companies get fined by the CIA for laying people off. You could probably sue for some sort of discrimination.
There are no government agencies to fine companies for laying people off.
The person who answered something about the CIA is either joking or does not know what they are talking about.
There is one issue. When an employee is fired for cause, they may not be able to collect unemployment benefits. When they are laid off, they will collect. Companies pay money into the unemployment pool. The amount a company pays can increase if a lot of their employees collect benefits. Hence it is an advantage if people get fired.
